1. Scope of Application
Nebuliton (Christian Hagenacker, Rutkamp 4, 24111 Kiel, hereinafter referred to as “Nebuliton”) provides all services
exclusively on the basis of these General Terms and Conditions (GTC). Deviating general terms and conditions of a
contractual partner are expressly not part of the contract. The GTC of Nebuliton valid at the time of conclusion of
the contract shall apply.
Deviations from these GTC are only effective if expressly confirmed in writing by Nebuliton.
Nebuliton offers hosting services such as game servers, root servers, domain provisioning and other services via
its platform. These GTC apply to all services used.
The contract language is German.
2. Conclusion of Contract
A contract is concluded when the customer orders a service via the WHMCS system and successfully completes the
payment for the booked service. The service is only automatically provisioned after receipt of payment.
The scope of the booked service is defined by the respective service description.
The customer is obliged to keep their access data confidential. The customer is liable for damages resulting from
the disclosure of access data insofar as the customer is responsible for this.
3. Services
Nebuliton provides virtual servers, game servers, domains and other hosting products. Use is only possible after
full payment has been made.
Interruptions may occur due to circumstances beyond Nebuliton’s control, such as technical faults or natural
disasters. Liability exists only in cases of intent or gross negligence.
Performance values are only binding if they are expressly stated in the service description.
4. Fair Use and Usage Obligations
The customer may only use the services in accordance with the contract. Transfer to third parties is not permitted
without an explicit agreement. In the event of abusive use, Nebuliton may block access.
In particular, the following are prohibited:
1. Cryptocurrency mining: Operating mining applications is not permitted.
2. CPU overclocking: Any overclocking of the CPU contrary to the manufacturer’s recommendations is prohibited.
3. Tor exit node: Operating a Tor exit node is prohibited.
4. Network scans: Scanning external networks or IP addresses is not permitted.
5. Spoofed source IPs: The use of spoofed IP sources is prohibited.
6. MAC changes: Manually changing the MAC address is not permitted.
7. Child pornography and illegal content: Hosting or distributing illegal content, especially child pornographic content, is strictly prohibited.
8. Malware distribution: Distributing viruses, trojans, worms or other malware is not permitted.
9. DDoS attacks: Initiating, supporting or carrying out DDoS attacks is prohibited.
10. Hacking activities: Performing or supporting hacking activities, including providing tools and scripts for hacking, is prohibited.
11. Phishing: Creating or operating phishing websites or services is prohibited.
12. Copyright infringements: Hosting or distributing copyrighted material without appropriate authorization is not permitted.
13. Spam: Sending spam emails or supporting spam activities is prohibited.
14. AI usage: The use of AI models, AI generators, AI training software or other high-load AI applications is permitted exclusively on dedicated servers. The use of such applications on KVM servers or comparable virtual environments is prohibited.
Traffic limits and throttling:
If the traffic limit specified in the product description is exceeded, the speed will automatically be reduced
to 5 Mbit/s – until the end of the billing period or until an upgrade is booked.
Data backup:
The customer is responsible for backing up their own data. Nebuliton operates internal backup systems but assumes
no liability for customer data, except in cases of intent or gross negligence.
The customer indemnifies Nebuliton against all third-party claims arising from unlawful use.
5. Payment and Prices
Prices are displayed before booking and become binding upon conclusion of the contract. The pay-as-you-go
principle applies: services are only provided after payment.
Payments are processed via external payment service providers. Nebuliton uses, among others, the payment providers
Mollie B.V., Keizersgracht 313, 1016 EE Amsterdam, Netherlands, and
Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.
Various payment methods may be offered via these payment service providers (e.g. credit card, SEPA direct debit,
instant transfer or other country-specific payment methods). The payment methods available in each case are shown
to the customer during the ordering process.
If a payment method offered via Mollie or Stripe is selected, payment processing takes place directly via the
systems of the respective payment service provider. Nebuliton does not receive access to complete payment data
such as credit card numbers or bank details.
The terms of use and privacy policies of the respective selected payment service provider also apply.
If automatic renewal is activated, the amounts due must be paid in good time. If no payment is made, a reminder
will be sent. If payment is not received within three working days, the service will be suspended and servers
will be automatically deleted.
6. Term
The contract ends automatically at the end of the booked term if no renewal takes place.
Both parties are entitled to extraordinary termination for good cause. Good cause exists in particular in the
event of serious or repeated breaches of duty by the customer.
7. Support
Support is provided exclusively via the following channels:

– Discord voice support (https://discord.gg/nebuliton)
– WHMCS ticket system (https://cp.nebuliton.io/submitticket.php?step=2&deptid=1)
8. Disclaimer of Liability
Nebuliton is only liable for damages resulting from injury to life, body or health that are based on a breach of
duty by Nebuliton or a vicarious agent, as well as for damages resulting from intent or gross negligence.
In cases of slight negligence, Nebuliton is only liable for breaches of essential contractual obligations
(cardinal obligations) and only for foreseeable, contract-typical damages.
Any further liability is excluded.
9. Right of Withdrawal and Information
Consumers are generally entitled to a 14-day right of withdrawal.
Important notice:
Once the selected hosting services are provided in our customer panel (https://cp.nebuliton.io),
our service has been fully performed. The right of withdrawal therefore expires.

10. Customer Contract Data
By placing the order, the customer confirms that they are at least 18 years old and that all information provided is complete and correct. Changes to the data must be communicated without delay.
11. Availability and Maintenance
Information on server availability is provided via the following channels:

Maintenance work will be announced in advance where possible.
12. Dispute Resolution
Nebuliton is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Jurisdiction and Applicable Law
German law shall apply. The place of jurisdiction is Kiel, provided the customer is a merchant, a legal entity under public law or a special fund under public law. Statutory provisions apply to consumers.
14. Severability Clause & Amendments
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain
unaffected.
Nebuliton may amend these GTC at any time. Changes will be announced at least 14 days before they take effect.
If the customer does not object within this period, the new GTC shall be deemed accepted. In the event of an
objection, the customer has a special right of termination.
